Game Locker Buyer Terms

These Buyer Terms apply if you are a Buyer (see the Game Locker Marketplace Terms), together with the Game Locker Marketplace Terms.

The sale contract between you and the Seller are in the Conditions of Sale.

If there's any inconsistency between these Buyer Terms and the Game Locker Marketplace Terms, these Buyer Terms apply to your buying activity.

1. Buying on the Marketplace

1.1 Accounts. You can make a purchase in the Marketplace either as a guest or through a Game Locker account.

1.2 Contact details. You must ensure the contact and delivery information you give us is accurate and current. You must be based in Australia and receiving the items in Australia.

1.3 Orders. By placing an order, you make a legally binding offer to purchase the relevant item(s) and the Conditions of Sale apply to your order. (If you purchase multiple items, the Conditions of Sale apply between you and each relevant Seller, for the item(s) you purchase from that Seller.) Placing an order doesn't guarantee the order will be fulfilled. The Seller may decline the offer under the Conditions of Sale or Game Locker may cancel the order, acting reasonably, if it suspects fraud or misuse of the Marketplace, an obvious error in the listing price of the item, breach of the Game Locker Marketplace Terms, or if payment cannot be processed for any reason. In those circumstances you will receive a full refund.

2. Guest Checkout

Guest checkout is only available if you're 18 or over; if you're under 18, you may only buy through an account operated by a parent or legal guardian (see clause 3 of the Game Locker Marketplace Terms). If you check out as a guest, you must provide a valid email address for order confirmation and communications about your order.

3. Payment

3.1 Price. The price payable for the items is the price shown to you at checkout, plus any displayed shipping or handling charges and GST.

3.2 Payment. You must pay for your order through the Game Locker checkout using a valid, accepted payment method. We collect payment on behalf of the Seller as the Seller's limited payment collection agent. Once you pay us, this satisfies your payment obligation to the Seller.

3.3 Payment processors. We collect payment via our third-party payment processors who directly process payments in accordance with their processing terms. Our processors may require you to comply with identity or account verification requirements as a condition of processing your payment. We are not responsible for the acts or omissions of our payment providers (unless they acted at our instruction).

4. Delivery and collection

As the default, orders are fulfilled by delivery using tracked shipping to your nominated address. You must select an available delivery or click-and-collect option at checkout. Not all options are available for all items or all the time. Sellers will fulfil orders using the delivery or click-and-collect method you selected at checkout. For click-and-collect, you must collect orders within the timeframe notified to you via the Marketplace. Refer to the Conditions of Sale for more detail.

5. Returns and refunds

Returns and refunds are handled under the Conditions of Sale (including the applicable Seller's returns policy shown on the relevant product listing or Seller profile (Seller Returns Policy)). For general information about returns and refunds, see the Shipping, Returns & Refunds Information.

6. Order Issues

Game Locker provides a Marketplace only. Listings are made by Sellers and when you buy, the Conditions of Sale are between you and the Seller, including the applicable Seller Returns Policy (Game Locker is not a party). If there's a problem with your order, contact the Seller first. If you are unable to resolve your concerns with the Seller, or you suspect the Seller is in breach of the Game Locker Marketplace Terms, Conditions of Sale, Seller Returns Policy or applicable laws, you can contact Game Locker Customer Service, your own legal advisers, the Australian Competition and Consumer Commission (ACCC) or your State or Territory consumer protection agency. Game Locker will use reasonable efforts to assist you but does not guarantee that it will resolve your issue or bring about any particular outcome.
