Game Locker Seller Returns Policy

It must be completed by each Seller before listing any items in the Marketplace, unless the Seller has uploaded its own returns policy to the Marketplace that offers at least the same level of buyer protection, meets any minimum requirements in the Shipping, Returns & Refunds Information and complies with all applicable laws. The minimum requirements in this policy are designed to ensure that all Buyers have peace of mind that they will receive the same minimum level of protection when making purchases in the Marketplace.
Game Locker may update this template Seller returns policy on notice in accordance with the Game Locker Marketplace Terms. Updates will only apply to new orders occurring after the update.]
Part A - Mandatory minimum requirements
This is the returns policy of [Seller full name], [address or forwarding address provided by GL], [email] and [phone number or forwarding number provided by GL] (Seller).
1. Returns we accept
The Seller will accept a return and provide a refund, replacement or other appropriate remedy (e.g. compensation or partial refund for the reduced value of a card) where:
- the condition of the card does not match its listing or description in the Marketplace;
- the buyer received the wrong card;
- a card is missing from the order;
- the card arrived damaged; or
- the Buyer has any other right to a remedy under the Australian Consumer Law (in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or State-based equivalent legislation (ACL)).
Subject to a Buyer’s rights under the ACL, for a minor problem, the Seller can choose to repair, replace or refund the item and for a major problem, the buyer can choose between a refund and a replacement.
2. Timeframes
In the event of a problem with an order, the Buyer should contact the Seller as soon as practicable within the Marketplace by [method] - if possible, within 48 hours.
Buyers need to make any claim within a reasonable time, which is generally 30 calendar days of the estimated delivery date or collection date unless there is a good reason for the delay.
The Seller must respond via the Marketplace within 3 business days.
If the Seller fails to comply with this Returns Policy or the parties have another issue under this Returns Policy, either party can contact Game Locker Customer Service for assistance. In some limited circumstances, Game Locker may be able to require a Seller to provide an appropriate remedy. Contacting Game Locker is an additional option, not a substitute for your legal rights, and Game Locker doesn't guarantee any particular outcome. You may also have rights under the ACL and you can contact your state or territory consumer protection agency, the ACCC or your own legal advisors for help.
3. Refunds
Refunds are based on the original purchase price, regardless of any change in the card’s market value since the sale. Refunds are provided to the Buyer’s original payment method.
Refunds are processed only after the Seller confirms receipt of the returned item and the return is valid under this Part A.
The Buyer bears the risk in the item until it is returned to the Seller, unless the Seller arranges for return postage, in which case risk transfers when the item is collected by the Seller’s carrier.
If the Seller arranges for return postage and agrees to bear the cost, then the Seller bears the cost of return postage. Otherwise, the Buyer bears the cost of return postage until the Seller confirms the item was validly returned under this Part A (at which time the Seller will refund the reasonable cost of return postage).
4. Australian Consumer Law
Nothing in this policy limits a right or remedy under the ACL that can’t lawfully be excluded.
If you are a consumer under the ACL:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Part B - Optional: change-of-mind returns
☒ Default: The Seller does not accept change-of-mind returns.
☐ Optional: The Seller accepts change-of-mind returns in its discretion, and provided that the Buyer:
- makes a request within [X] days of delivery or collection
- returns the item it its original, unused condition, including in any packaging, unopened
- properly packages the item to protect it against loss and damage
- arranges and pays for return postage with a reputable carrier, using tracked postage or delivery or uses the Seller’s nominated carrier and carriage service for the return
- the Buyer is fully responsible for risk of damage to or loss of the item while in transit (unless the Seller’s carrier is used)
- the Buyer pays a restocking or returns fee of [insert].
